Terms and Conditions for Makeup Services

Please read these terms and conditions carefully before using the makeup services provided by Jaíme Sanstra ("the Makeup Artist"). By booking an appointment or using the Makeup Artist's services, you agree to comply with and be bound by the following terms and conditions:

Appointment Booking and Cancellation:
1.1. All appointments must be booked in advance through the Makeup Artist's preferred communication channel.
1.2. Appointments are valid after formal and written confirmation by the Makeup Artist.
1.3. A deposit or full payment may be required to secure your appointment, as determined by the Makeup Artist.
1.4. Cancellations or rescheduling of appointments must be made at least 48 hours in advance. Failure to provide adequate notice may result in a cancellation fee or loss of deposit.
1.5. The Makeup Artist reserves the right to cancel or reschedule an appointment due to unforeseen circumstances. In such cases, the Makeup Artist will provide reasonable notice and offer alternative arrangements or a refund.
Services Provided:
2.1. The Makeup Artist offers professional makeup services for various occasions, including but not limited to weddings, events, photoshoots, and special occasions.
2.2. The Makeup Artist will discuss the client's requirements, preferences, and any relevant details to ensure satisfactory service delivery.
2.3. The Makeup Artist will provide makeup products, tools, and equipment necessary for the services, maintaining high hygiene standards and using professional-grade products.
Client Responsibilities:
3.1. The client agrees to provide accurate and truthful information about their skin type, allergies, sensitivities, and any other relevant medical conditions that may affect the makeup application.
3.2. The client must arrive at the appointment with a clean, makeup-free face unless otherwise instructed by the Makeup Artist.
3.3. The client is responsible for notifying the Makeup Artist of any changes in the client's health, skin conditions, or allergies that may affect the makeup application.
3.4. The client agrees to follow the Makeup Artist's instructions for post-application care and maintenance to ensure the longevity of the makeup.
Payment and Pricing:
4.1. The Makeup Artist's prices and payment methods will be communicated to the client prior to the appointment.
4.2. Payment must be made in full at the time of service unless otherwise agreed upon by both parties.
4.3. Additional charges may apply for any extra services or products requested by the client during the appointment, which will be communicated and agreed upon by both parties.
Liability and Indemnification:
5.1. The Makeup Artist will exercise reasonable care and skill when providing makeup services. However, the Makeup Artist shall not be held liable for any allergic reactions, injuries, or damages that may arise as a result of the client's negligence, failure to follow instructions, or undisclosed medical conditions.
5.2. The client agrees to indemnify and hold the Makeup Artist harmless from any claims, liabilities, losses, or expenses incurred as a result of the client's actions or omissions.
Intellectual Property:
6.1. The client acknowledges that any makeup designs, styles, or creations developed by the Makeup Artist during the service remain the intellectual property of the Makeup Artist.
6.2. The client grants the Makeup Artist permission to use photographs or videos of the makeup application for promotional purposes, unless otherwise agreed upon in writing.
Confidentiality:
The Makeup Artist agrees to maintain the confidentiality of any personal information provided by the client and to use it solely for the purpose of providing makeup services.
Governing Law and Jurisdiction:
These terms and conditions shall be governed by and construed in accordance with the Belgian law. Any disputes arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Belgium.

By booking an appointment with the Makeup Artist or using their services, you acknowledge that you have read, understood, and agree to be bound by these terms and conditions.

Algemene Voorwaarden voor Make-up Diensten

Lees deze algemene voorwaarden zorgvuldig door voordat u gebruikmaakt van de make-updiensten die worden aangeboden door Jaíme Sanstra ("de Make-upartiest"). Door een afspraak te maken of gebruik te maken van de diensten van de Make-upartiest, stemt u ermee in om te voldoen aan en gebonden te zijn aan de volgende algemene voorwaarden:

1. Afspraak maken en annuleren:

1.1. Alle afspraken moeten van tevoren worden gemaakt via het voorkeurscommunicatiekanaal van de Make-upartiest.
1.2. Alle afspraken zijn geldig na formele en schriftelijke bevestiging van de Make-upartiest.
1.3. Een aanbetaling of volledige betaling kan vereist zijn om uw afspraak te bevestigen, zoals bepaald door de Make-upartiest.
1.4. Annuleringen of wijzigingen van afspraken moeten ten minste 48 uur van tevoren worden gedaan. Bij onvoldoende kennisgeving kan er een annuleringsvergoeding of verlies van aanbetaling gelden.
1.5. De Make-upartiest behoudt zich het recht voor om een afspraak te annuleren of te wijzigen vanwege onvoorziene omstandigheden. In dergelijke gevallen zal de Make-upartiest tijdige kennisgeving geven en alternatieve regelingen aanbieden of een terugbetaling doen.

2. Geleverde diensten:

2.1. De Make-upartiest biedt professionele make-updiensten voor verschillende gelegenheden, waaronder maar niet beperkt tot bruiloften, evenementen, fotoshoots en speciale gelegenheden.
2.2. De Make-upartiest zal de wensen, voorkeuren en relevante details van de klant bespreken om een bevredigende dienstverlening te garanderen.
2.3. De Make-upartiest zal make-upproducten, gereedschappen en apparatuur verstrekken die nodig zijn voor de diensten, waarbij hoge hygiënenormen worden gehanteerd en professionele producten worden gebruikt.

3. Verantwoordelijkheden van de klant:

3.1. De klant stemt ermee in om accurate en waarheidsgetrouwe informatie te verstrekken over hun huidtype, allergieën, gevoeligheden en andere relevante medische aandoeningen die van invloed kunnen zijn op de make-upapplicatie.
3.2. De klant moet bij de afspraak arriveren met een schoon, make-upvrij gezicht, tenzij anders aangegeven door de Make-upartiest.
3.3. De klant is verantwoordelijk voor het melden van eventuele veranderingen in de gezondheid, huidaandoeningen of allergieën die van invloed kunnen zijn op de make-upapplicatie.
3.4. De klant stemt ermee in om de instructies van de Make-upartiest op te volgen met betrekking tot nazorg en onderhoud om de duurzaamheid van de make-up te waarborgen.

4.Betaling en prijsstelling:

4.1. De prijzen en betalingsmethoden van de Make-upartiest worden vooraf aan de klant meegedeeld.
4.2. Betaling dient volledig te geschieden op het moment van de dienstverlening, tenzij anders overeengekomen door beide partijen.
4.3. Extra kosten kunnen van toepassing zijn voor eventuele extra diensten of producten die door de klant tijdens de afspraak worden aangevraagd. Deze kosten worden gecommuniceerd en overeengekomen door beide partijen.

5.Aansprakelijkheid en vrijwaring:

5.1. De Make-upartiest zal redelijke zorg en vakbekwaamheid betrachten bij het verlenen van make-updiensten. De Make-upartiest kan echter niet aansprakelijk worden gesteld voor allergische reacties, verwondingen of schade die kan ontstaan als gevolg van nalatigheid van de klant, het niet opvolgen van instructies of niet gemelde medische aandoeningen.
5.2. De klant stemt ermee in om de Make-upartiest schadeloos te stellen en te vrijwaren van eventuele vorderingen, aansprakelijkheden, verliezen of uitgaven als gevolg van de acties of nalatigheden van de klant.

6. Intellectueel eigendom:

6.1. De klant erkent dat alle make-upontwerpen, stijlen of creaties die door de Make-upartiest tijdens de dienstverlening worden ontwikkeld, het intellectueel eigendom van de Make-upartiest blijven.
6.2. De klant verleent de Make-upartiest toestemming om foto's of video's van de make-upapplicatie te gebruiken voor promotionele doeleinden, tenzij anders schriftelijk overeengekomen.

7. Vertrouwelijkheid:

De Make-upartiest stemt ermee in om de vertrouwelijkheid van alle persoonlijke informatie die door de klant wordt verstrekt te waarborgen en deze uitsluitend te gebruiken voor het verlenen van make-updiensten.

8. Toepasselijk recht en jurisdictie:

Deze algemene voorwaarden worden beheerst door en geïnterpreteerd in overeenstemming met de wetten van het Belgisch recht. Geschillen die voortvloeien uit of verband houden met deze algemene voorwaarden vallen onder de exclusieve bevoegdheid van de rechtbanken van België.

Door een afspraak te maken met de Make-upartiest of gebruik te maken van hun diensten, erkent u dat u deze algemene voorwaarden hebt gelezen, begrepen en ermee akkoord gaat om eraan gebonden te zijn.
